What a real estate agent's website must show in Oklahoma

Oklahoma's advertising rule, OAC 605:10-9-4, requires every associate (agent) ad to include the broker's name or trade name in a way that is "prominent, conspicuous and easily identifiable", and the rule defines that by size against the agent's own name or team name. An agent's website must use a domain registered with the broker, with the broker's reference on every page. Teams must register their name with the Commission, include "team" or "group" in it, and never advertise under the team name alone.

Does a website count as advertising in Oklahoma?

  • The rule applies to advertising "in any media", and it addresses social networking and websites specifically. OAC 605:10-9-4

“A licensee who is engaged in licensed activities through social networking mediums must indicate their license status and include their broker's reference as required elsewhere in this rule.”

What every advertisement must show

  • For an associate: the broker's name or the name under which the broker operates, in all advertising, prominent, conspicuous and easily identifiable, which the rule defines by size against any reference to you. OAC 605:10-9-4

“"prominent, conspicuous and easily identifiable" means that the broker's reference shall be at least fifty percent (50%) or larger than any associate reference included in the advertisement”
  • For a broker: the registered business trade name or licensed name, plus an indication that the advertiser is a real estate broker and not a private party (such as "agency", "company", "realty" or "real estate"). OAC 605:10-9-4

  • Under a franchise name: the franchise name together with the broker's name or registered trade name; franchise-wide advertising must say each office is independently owned and operated. OAC 605:10-9-4

Websites specifically

  • An agent's website domain must be registered with the broker, and within it the broker's reference must appear on every individual page or frame. OAC 605:10-9-4

“A domain/website name that is registered with the broker. Within this domain/website, the broker's reference shall appear on every individual page and/or frame.”
  • On social networking, show your license status and the broker's reference as the rule requires elsewhere. OAC 605:10-9-4

Team names

  • A team may not advertise only under its team name. All team advertising is under the broker's direct supervision and must include the broker's name, with the same size test as for agents, measured against the team reference. OAC 605:10-9-4

“the broker's reference shall be at least fifty percent (50%) or larger than any team reference included in the advertisement”
  • The broker registers each team name with the Commission before the team does any licensed activity ($100 per name). The name must contain "team" or "group", be approved by the broker, and be unique in Oklahoma. OAC 605:10-9-3.2

  • A team's website domain must be registered with the broker, with the broker's reference on every page or frame. OAC 605:10-9-4

What gets agents in trouble

  • An agent advertising under only their own name, or a team under only its team name. OAC 605:10-9-4

  • Ads showing only a post office box, phone number or street address. OAC 605:10-9-4

  • Advertising a property without the owner's (or authorised representative's) permission, with a definite expiration date, secured by the broker. OAC 605:10-9-4

  • Advertising that is misleading or inaccurate in any material fact, or that is directed at or refers to persons of a particular race, color, creed, religion, national origin, familial status, age or handicap. OAC 605:10-9-4

Worth knowing

  • With the broker's approval an agent may add a personal insignia, a nickname registered with the Commission, contact information and a slogan, none of which may look like a firm's name. OAC 605:10-9-4

  • Advertising your own property, or property you are buying, must disclose that you are licensed; a license number is required on the purchase or lease contract, not in the ad. OAC 605:10-9-4

How SiteCurb handles this

Every SiteCurb site has a broker-disclosure footer on every page, listings included: your name, your brokerage and your license number, plus a disclosure field for the text and links your state requires (Texas agents get a one-click helper for the two TREC links). Fill it in once and it is on every page.

How many agents this applies to

1,407 real estate agents were working in Oklahoma when we last counted, across 10 brokerage offices. That is agents with a live profile on a brokerage's own site, not everyone holding a licence, so it is the population these rules actually bind day to day. The Oklahoma brokerage directory breaks it down office by office. Counted 2026-10-07.

This page paraphrases the rules; the rules themselves are what bind you. Each was read on the date shown. If the OREC changes a rule, the page will lag until it is read again.

Not legal advice. When a rule and this page disagree, the rule wins; when in doubt, ask your broker or the OREC.

Questions people ask

What has to be on my website in Oklahoma?

Your broker's name or trade name on every page, prominent and easy to identify, sized according to the rule's test against your own name, and the domain must be registered with your broker. On SiteCurb the broker-disclosure footer carries your brokerage on every page; if your name is large in the header, show the brokerage name there too.

Does my team name need to be registered?

Yes. Your broker registers it with the Commission before the team does any licensed activity, it must include "team" or "group", and team ads must always carry the broker's name.

Can my site use my own domain name?

Yes, if the domain is registered with your broker and the broker's reference is on every page of the site.
