What a real estate agent's website must show in North Dakota
North Dakota's advertising rule, 70-02-03-02.1 (amended July 2022), requires all advertising to be in the brokerage agency's trade name as licensed with the Commission, with the trade name equal to or greater in size and visibility than any agent's or team's name, plus information on how to contact the brokerage. Agents may add their own name and phone number as long as the brokerage's name and contact information are clearly included. Teams may not advertise in a way that suggests they are an independent brokerage.
Updated Rules read 2026-10-07
Does a website count as advertising in North Dakota?
The rule covers all representation, promotion and solicitation for real estate brokerage, disseminated "in any manner and by any means of communication", so websites and social media are covered. There is no website-specific provision. N.D. Admin. Code 70-02-03-02.1
“include all forms of representation, promotion, and solicitation disseminated in any manner and by any means of communication for any purpose related to real estate brokerage activity”
What every advertisement must show
The brokerage agency's trade name as licensed with the Commission, equal to or greater in size and visibility than the name of any salesperson, associate broker or team in the ad. N.D. Admin. Code 70-02-03-02.1
“Advertising must be done in the real estate brokerage agency's trade name as licensed with the commission and the trade name must be equal to or greater than, in size and visibility, the name of any salesperson, associate broker, or team on the advertising.”
Information on how the public can contact the real estate brokerage agency. N.D. Admin. Code 70-02-03-02.1
“Advertising must include information on how the public can contact the real estate brokerage agency.”
Websites specifically
There is no website-specific rule. A website is advertising like any other: the brokerage's trade name, no smaller or less visible than your name, and how to contact the brokerage. N.D. Admin. Code 70-02-03-02.1
Your own name and phone number or other contact information may appear, under the designated broker's supervision, as long as the brokerage's name and contact information are clearly included too. N.D. Admin. Code 70-02-03-02.1
Team names
A team is two or more licensees at the same brokerage, under the designated broker, working together under a team name. Team advertising follows all the same rules, with the brokerage trade name at least as large and visible as the team name. N.D. Admin. Code 70-02-03-02.1
Teams may not advertise in any manner suggesting the team is an independent real estate brokerage. The rule has no team-name word list. N.D. Admin. Code 70-02-03-02.1
“Teams may not advertise in any manner which suggests a team is an independent real estate brokerage firm.”
What gets agents in trouble
Deceptive advertising, or misrepresenting the terms of a sale or purchase, the brokerage's policies or its services. N.D. Admin. Code 70-02-03-02.1
An agent's or team's name larger or more visible than the brokerage's trade name. N.D. Admin. Code 70-02-03-02.1
Worth knowing
Advertising your own property in your own name requires "Owner/Licensed Broker" or "Owner/Licensed Salesperson" right after your name, active or inactive license alike. N.D. Admin. Code 70-02-03-02.1
70-02-03-02.1 does not require a license number; it requires the brokerage trade name and its contact information. N.D. Admin. Code 70-02-03-02.1
Every SiteCurb site has a broker-disclosure footer on every page, listings included: your name, your brokerage and your license number, plus a disclosure field for the text and links your state requires (Texas agents get a one-click helper for the two TREC links). Fill it in once and it is on every page.
How many agents this applies to
246 real estate agents were working in North Dakota when we last counted, across 4 brokerage offices. That is agents with a live profile on a brokerage's own site, not everyone holding a licence, so it is the population these rules actually bind day to day. The North Dakota brokerage directory breaks it down office by office. Counted 2026-10-07.
