What a real estate agent's website must show in Kansas

Kansas's advertising rules are in the statute, K.S.A. 58-3086, and the Commission's regulation, K.A.R. 86-3-7. All advertising by a licensee must prominently and conspicuously display the supervising broker's trade name or business name, readably, under the broker's direct supervision. Advertising expressly includes websites, social media and email. An agent's or team's name may not use "realty", "brokerage" or "company", may be no more than twice the font size of the broker's name, and online must sit next to the broker's name.

Does a website count as advertising in Kansas?

  • Yes, by name. The regulation defines advertising as communication in any form of media for licensed real estate activity, and lists internet advertising, web sites, social media and social networking, and email. K.A.R. 86-3-7

“These terms shall include business cards, signs, insignias, letterheads, telephone or electronic mail, radio, television, newspaper and magazine advertisements, internet advertising, web sites, social media or social networking”

What every advertisement must show

  • The supervising broker's trade name or business name, prominently and conspicuously displayed (or announced) in a readable and identifiable manner. K.S.A. 58-3086

“include the name of the supervising broker's trade name or business name by prominently and conspicuously displaying or announcing the supervising broker's trade name or business name in a readable and identifiable manner”
  • Anything else the supervising or branch broker considers necessary. All advertising is under the broker's direct supervision. K.S.A. 58-3086

Websites specifically

  • In any internet, website, social media or social networking ad, your name or team name must be adjacent to the supervising broker's trade name or business name. K.A.R. 86-3-7

“is not adjacent to the supervising broker's trade name or business name in any internet, web site, social media, or social networking advertisement”
  • With the broker's authorisation, an agent may use their own contact information, a name or team name, a slogan, and a domain name or website, as long as none can be taken for the broker's trade or business name. K.S.A. 58-3086

Team names

  • A salesperson's or associate broker's name or team name may not use "realty", "brokerage", "company" or any term suggesting a real estate company separate from the supervising broker's. K.A.R. 86-3-7

  • A name or team name may be no more than twice the font size of the supervising broker's trade or business name, and the Commission may consider the ad's context. K.A.R. 86-3-7

“is more than two times larger in font size than the font size of the supervising broker's trade name or business name”

What gets agents in trouble

  • Advertising in any media that is misleading or inaccurate as to any material fact, or misrepresents any property, terms, values, policies or services. K.S.A. 58-3086

  • Using another organization's name, mark or logo without authorisation, or naming an office that isn't a designated primary or branch office. K.S.A. 58-3086

  • Terms, trade names or business names that could be confused with the supervising broker's. K.S.A. 58-3086

Worth knowing

  • Your own property, not listed with a broker, can be advertised without the broker's name, but the ad must make clear a real estate licensee owns it or has an interest. Soliciting property to buy for yourself without a buyer's agency agreement must also disclose that a licensee is involved. K.S.A. 58-3086

  • Neither K.S.A. 58-3086 nor K.A.R. 86-3-7 requires a license number in advertising. K.S.A. 58-3086K.A.R. 86-3-7

How SiteCurb handles this

Every SiteCurb site has a broker-disclosure footer on every page, listings included: your name, your brokerage and your license number, plus a disclosure field for the text and links your state requires (Texas agents get a one-click helper for the two TREC links). Fill it in once and it is on every page.

How many agents this applies to

1,798 real estate agents were working in Kansas when we last counted, across 12 brokerage offices. That is agents with a live profile on a brokerage's own site, not everyone holding a licence, so it is the population these rules actually bind day to day. The Kansas brokerage directory breaks it down office by office. Counted 2026-10-07.

This page paraphrases the rules; the rules themselves are what bind you. Each was read on the date shown. If the KREC changes a rule, the page will lag until it is read again.

Not legal advice. When a rule and this page disagree, the rule wins; when in doubt, ask your broker or the KREC.

Questions people ask

What has to be on my website in Kansas?

Your supervising broker's trade name or business name, prominently and readably, placed next to your name or team name, and your name no more than twice the font size of the broker's. On SiteCurb the broker-disclosure footer carries the brokerage on every page; keep the brokerage name beside your name in the header too.

Can my team be called "Smith Realty"?

No. Team names can't use "realty", "brokerage" or "company", or anything that could pass for a separate real estate company.

Can I use my own domain name?

Yes, with your broker's authorisation, as long as the domain doesn't include terms that could be taken for the broker's trade or business name or that confuse the public.
