What a real estate agent's website must show in Montana

Montana's rules require "licensee identification" in advertising: your name, and a statement that the ad is made by a real estate licensee or by a brokerage company. A separate internet advertising rule, ARM 24.210.430, covers websites, blogs, video streaming and social media: every viewable page you own or control should include or link to that identification, internet ads must show the date they were created and last updated, and listings must be updated within seven days of a material change.

Does a website count as advertising in Montana?

  • Yes, by name. The internet advertising rule applies to any form of internet advertising, including websites, blogs, video streaming and social media; traditional advertising is covered by the general conduct rule. ARM 24.210.430ARM 24.210.641

“Licensees who engage in any form of Internet advertising, including, but not limited to, web sites, blogs, video streaming, and social media, either directly or indirectly, shall comply with the Internet advertising rules set out in this rule.”

What every advertisement must show

  • Licensee identification: your name, and a statement that the advertisement is made by a real estate licensee or by a brokerage company. ARM 24.210.301ARM 24.210.641

“"Licensee identification" as used in this chapter means a written disclosure of the licensee's name, and identifying that the advertisement is made by a real estate licensee or by a brokerage company.”

Websites specifically

  • On a web page you or your brokerage own or control, every viewable page should include, or link to, the licensee identification. ARM 24.210.430

  • Internet advertising must be current, show the date it was created and last updated, and be updated within seven days of a material change to the listing (expiration, termination or amendment). ARM 24.210.430

“Internet advertising shall indicate the date on which it was created and last updated.”
  • Email (unless you've already identified yourself to every recipient), discussion boards, chats and banner ads have their own placement rules; required disclosures must be in a size, color, type and place a reasonable person will notice and can read. ARM 24.210.430

  • Showing other brokers' listings needs the listing agent's cooperation and consent (an MLS's rules can supply it) and the owner's consent; you must name the listing agent or brokerage, and not change the data. Condensed data needs a statement that it was abstracted from another source. ARM 24.210.430

Team names

  • Montana's rules have no team provision. Team advertising follows the same licensee identification and internet rules. ARM 24.210.641ARM 24.210.430

What gets agents in trouble

  • Advertising without your name and an indication that the ad is by a real estate licensee or a brokerage company. ARM 24.210.641

  • Internet advertising that doesn't truthfully and accurately describe the property or service, or a property ad that doesn't give its city, town or county. ARM 24.210.430

  • Advertising as a real estate licensee while your license is expired or inactive. ARM 24.210.641

Worth knowing

  • The rules do not expressly require the brokerage's name or a license number; licensee identification can be met by your name plus a statement that you are a real estate licensee. ARM 24.210.301

How SiteCurb handles this

Every SiteCurb site has a broker-disclosure footer on every page, listings included: your name, your brokerage and your license number, plus a disclosure field for the text and links your state requires (Texas agents get a one-click helper for the two TREC links). Fill it in once and it is on every page.

How many agents this applies to

473 real estate agents were working in Montana when we last counted, across 8 brokerage offices. That is agents with a live profile on a brokerage's own site, not everyone holding a licence, so it is the population these rules actually bind day to day. The Montana brokerage directory breaks it down office by office. Counted 2026-10-07.

Sources

This page paraphrases the rules; the rules themselves are what bind you. Each was read on the date shown. If the Board changes a rule, the page will lag until it is read again.

Not legal advice. When a rule and this page disagree, the rule wins; when in doubt, ask your broker or the Board.

Questions people ask

What has to be on my website in Montana?

On every viewable page (or a link from it): your name and a statement that you are a real estate licensee or that the ad is by a brokerage company. The site must show when it was created and last updated, and listings must be updated within seven days of a material change. On SiteCurb the broker-disclosure footer puts your name and brokerage on every page; add the last-updated date in the disclosure field.

Do emails need anything?

Yes. Put your licensee identification at the beginning or end of each email, unless every recipient has already received it from you.

Can I show other agents' listings?

Yes, with the listing agent's consent (an MLS's rules can provide it) and the owner's, naming the listing agent or brokerage and leaving the data unchanged.
