What a real estate agent's website must show in New Mexico
New Mexico's advertising rule, 16.61.32.8 NMAC, applies to all forms of advertising, online and electronic media included. An associate broker's ads must include the brokerage's trade name and current telephone number as registered with the Commission, prominently displayed in a type size no less than 33 percent of the associate broker's name (or the team's name). Short electronic displays like thumbnails, texts, links and tweets of 200 characters or less can instead link to a display with the disclosures.

What gets agents in trouble
Advertising that isn't a true and factual representation of the property, the services or the brokerage, or that would confuse or mislead the public. 16.61.32.8 NMAC
Advertising property you own or partly own for sale or exchange without saying, in the ad and on signs, that you own it (unless a third-party broker lists it). 16.61.32.8 NMAC
Using the brokerage's phone number in an ad for your own property without also showing the brokerage's registered trade name. 16.61.32.8 NMAC
Worth knowing
16.61.32.8 NMAC does not require a license number; it requires the brokerage trade name and telephone number as registered with the Commission. 16.61.32.8 NMAC
Every SiteCurb site has a broker-disclosure footer on every page, listings included: your name, your brokerage and your license number, plus a disclosure field for the text and links your state requires (Texas agents get a one-click helper for the two TREC links). Fill it in once and it is on every page.
How many agents this applies to
1,156 real estate agents were working in New Mexico when we last counted, across 7 brokerage offices. That is agents with a live profile on a brokerage's own site, not everyone holding a licence, so it is the population these rules actually bind day to day. The New Mexico brokerage directory breaks it down office by office. Counted 2026-10-07.
