What a real estate agent's website must show in Colorado

Colorado's rule is built around the brokerage firm: all advertising must be done clearly and conspicuously in the name of your brokerage firm, and when you own or control a website, every viewable page must carry the firm's name. Expired listings have to come off your site within three days. Team names may not contain "realty", "real estate", "Realtors", "company" or any corporate suffix, and every team ad must sit alongside the firm's legal or trade name.

Does a website count as advertising in Colorado?

  • Advertising is the promotion, solicitation or representation of brokerage services, and Chapter 1 lists websites, social media, electronic mailings and email signatures among its examples. A bare URL or email address is not advertising unless it is used directly to promote or solicit. Electronic Media includes websites, electronic mailings, social media, banner ads, virtual tours and YouTube; a "Viewable Page" is any page, scrolling or not, including frame pages. 4 CCR 725-1, Chapter 6, Rule 6.104 CCR 725-1, Chapter 1

    Electronic Media may include, but is not limited to, websites, electronic mailings, social media such as Twitter and Facebook, banner advertisements, virtual tours, and YouTube.

What every advertisement must show

  • Your brokerage firm's name, clearly and conspicuously, on all advertising. The one exemption is property you own that is not listed with your firm. 4 CCR 725-1, Chapter 6, Rule 6.10

  • The name under which you and your firm appear in the Commission's records — nothing else. A firm may also show its office and branch locations. 4 CCR 725-1, Chapter 6, Rule 6.10

  • If your firm uses a trade name or trademark owned by someone else (a franchise), one of two statements in a clear and conspicuous manner: "Each (trade name) brokerage business is independently owned and operated." or "Each office independently owned and operated." 4 CCR 725-1, Chapter 6, Rule 6.10

Websites specifically

  • When you own or control the electronic media, each viewable page must include your brokerage firm's name. A viewable page is "a page that may or may not scroll beyond the border of the screen and includes the use of frame pages" — so a long scrolling page counts once, but every separate page counts. 4 CCR 725-1, Chapter 6, Rule 6.104 CCR 725-1, Chapter 1

  • Expired listings must be removed from your site within three days of the listing contract expiring. If a third party syndicates your listings, you must send a written request to remove expired listings within the same three days. 4 CCR 725-1, Chapter 6, Rule 6.10

  • Email, chat, instant messages, newsgroups, discussion lists, bulletin boards and blogs used to advertise must use the firm's name — though once you have disclosed your firm to a specific consumer you need not repeat it to them. 4 CCR 725-1, Chapter 6, Rule 6.10

  • Where space is genuinely limited, the firm's name must be disclosed clearly and conspicuously within the first click. 4 CCR 725-1, Chapter 6, Rule 6.10

Team names

  • A team is two or more brokers within one brokerage firm who cooperate on an ongoing basis to conduct a substantial portion of their brokerage services together. 4 CCR 725-1, Chapter 1

  • A team name may not include Realty, Real estate, Realtors, Company, Corporation, Corp., Inc., LLC, LP, LLP, or any other term implying a separate entity from the brokerage firm. 4 CCR 725-1, Chapter 6, Rule 6.10

  • All team advertising must clearly and conspicuously include, and sit in conjunction with, the legal name or trade name of the brokerage firm. 4 CCR 725-1, Chapter 6, Rule 6.10

  • Colorado does not require a license number in advertising under Rule 6.10; it requires the brokerage firm's name as recorded with the Commission. 4 CCR 725-1, Chapter 6, Rule 6.10

  • You are responsible for the accuracy of everything in your advertising, including MLS data and the identification of the brokers involved in a sale, though you have no duty to investigate what a seller or an assessor's record tells you. 4 CCR 725-1, Chapter 6, Rule 6.10
